These Terms of Service (“Terms”) govern your access to and use of the Buckaroo Endurance website and storefront (the “Services”). By accessing or using the Services, placing an order, or otherwise interacting with Buckaroo Endurance (“we,” “us,” or “our”), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

You must have the legal capacity to enter into a binding agreement to use the Services or place an order. If you do not have that capacity, you may use the Services only with the involvement of a parent or legal guardian, as permitted by applicable law.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to interfere with the operation, security, or underlying networks of the Services, or with our ability to process orders and conduct commerce through the site.

Buckaroo Endurance sells, or intends to sell, endurance nutrition and supplement products and related goods, including our ROO product line. We aim to present product descriptions, imagery, ingredient information, pricing, and availability as accurately as reasonably possible, but we do not guarantee that every listing, image, color, specification, or price is always complete, current, or error-free.

We reserve the right to correct any errors, inaccuracies, or omissions, and to update or change product information, including pricing and availability, at any time without prior notice.

Educational and product content on this website — including ingredient overviews, usage guidance, and interactive tools such as our hydration planning tool — is provided for general informational purposes only. These tools offer a general starting point, not an individualized prescription or medical assessment, and are not a substitute for consultation with a qualified healthcare professional.

Individual needs and responses to nutrition and supplement products vary. Talk to a healthcare professional before starting any new supplement, especially if you are pregnant or nursing, are under 18, have a medical condition, or are taking medication.

When you place an order, you agree to provide accurate, current, and complete information. You are responsible for reviewing your order, including product selection, quantity, and shipping details, before completing checkout.

We reserve the right to refuse, limit, or cancel an order where reasonably necessary — for example, if a product is unavailable, if we identify a genuine pricing or listing error, or if we suspect fraud, abuse, or an unauthorized transaction. Where we cancel an order for these reasons, we will let you know and issue a refund for any amount already charged for the cancelled portion.

Checkout and payment processing are handled by Shopify and its payment providers. We do not directly collect, view, or store your complete payment card number.

Prices displayed on the site may change at any time on a going-forward basis. Changes to pricing do not affect orders that have already been completed at checkout.

Return and refund eligibility is described in our Return Policy, which forms part of these Terms.

From time to time we may run promotions, giveaways, contests, or similar offers, such as the Sample Pack Giveaway. These may be subject to additional eligibility requirements or rules disclosed with the applicable promotion, including on our Promotions & Giveaway Terms page. Where a promotion has its own rules, those rules govern that promotion in addition to these Terms.

The Buckaroo Endurance and ROO names, logos, product names, photography, graphics, copy, video, website design, and other original materials on this site are owned by Buckaroo Endurance or its licensors and are protected by applicable intellectual property laws. We do not claim ownership of third-party trademarks or materials that appear on the site.

You may view and access this content for personal, noncommercial use. You may not reproduce, distribute, commercially exploit, or use our intellectual property in a misleading way without our prior written permission.

When using the Services, you agree not to:

• Use the Services for any unlawful purpose or in furtherance of fraud;
• Attempt to gain unauthorized access to the site, its systems, or other users’ accounts or data;
• Introduce viruses, malicious code, or anything designed to disrupt or damage the Services;
• Interfere with the security, integrity, or normal operation of the site;
• Scrape, harvest, or use automated means to access the site in a way that places unreasonable load on it or misuses its content;
• Impersonate any person or entity, or misrepresent your affiliation with us; or
• Abuse, exploit, or attempt to circumvent the intended limits of a promotion, giveaway, or checkout functionality.

We use third-party services, including Shopify, to operate our storefront, and the site may link to third-party websites or services we do not own or control. We are not responsible for the content, practices, or terms of those third parties, and your use of any third-party site or service is subject to its own terms and privacy practices.

If you opt in to receive text messages from us, that participation is governed by our separate SMS Terms. Consent to receive marketing text messages is never a condition of purchase.

If you voluntarily subscribe to marketing emails, you can unsubscribe at any time using the link included in those emails. Subscribing to marketing emails is never a condition of purchase.

Our collection and use of personal information in connection with the Services is described in our Privacy Policy, which forms part of these Terms.

To the fullest extent permitted by applicable law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that the Services will operate uninterrupted or error-free, that every product is suitable for every individual, or any particular outcome from using our products. Nothing in this section limits any right or warranty that cannot lawfully be excluded.

To the fullest extent permitted by applicable law, Buckaroo Endurance will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services or our products. Nothing in these Terms limits any liability that cannot lawfully be limited or excluded under applicable law.

You agree to indemnify and hold Buckaroo Endurance harmless from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your unlawful use of the Services, your violation of these Terms, or your infringement of the rights of a third party.

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-laws principles, without prejudice to any consumer protections you are entitled to under the laws of your place of residence.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect to the extent permitted by law.

Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Entire Agreement. These Terms, together with the policies expressly incorporated by reference, make up the entire agreement between you and Buckaroo Endurance regarding the Services, except where a specific promotion or offer states that separate rules apply.

We may update these Terms from time to time as our operations, Services, or applicable legal requirements change. Changes take effect once the updated Terms are posted on this page, and the “Last updated” date above reflects the most recent revision. Your continued use of the Services after an update takes effect constitutes acceptance of the revised Terms.
